DMCA Policy

1. Overview

Marketwood respects the intellectual property rights of creators and expects all users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond promptly to notices of alleged copyright infringement that comply with the DMCA and any other applicable intellectual property laws.

2. Reporting Copyright Infringement

If you believe that content on Marketwood infringes your copyright, use the "Report" button on the product page and select "Copyright" as the reason. Include as much detail as possible about the original work and the nature of the infringement.

For formal DMCA takedown notices requiring a sworn statement, email support@marketwood.shop with the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. The URL of the infringing material on Marketwood.
  4. Your contact information (name, address, telephone number, email).
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

We aim to review and respond to all reports within 2 business days.

3. Action on Valid Notices

Upon receiving a valid DMCA takedown notice, Marketwood will:

  • Remove or disable access to the allegedly infringing material.
  • Notify the user who posted the material that it has been removed.
  • Provide the user with information about how to submit a counter-notification.

4. Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification by emailing support@marketwood.shop. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed material.

5. Repeat Infringers

Marketwood will, in appropriate circumstances, terminate the accounts of users who are repeat infringers. We track copyright complaints per creator account and may suspend or permanently remove accounts with multiple valid claims.

6. Good Faith

Please be aware that filing a false DMCA notice may result in legal liability. Before submitting a takedown notice, please consider whether the use of the copyrighted material may qualify as fair use.
